These terms govern access to and use of Monestic. By registering or using the service, you agree to be bound by them. If you do not agree, do not use the service.
1. Identification and acceptance
The owner of the service is Birrastorming Ideas S.L., tax ID B98498496, with registered address at [REGISTERED ADDRESS] (hereinafter “Monestic”). Use of the service implies full acceptance of these terms and of the Privacy Policy.
2. Purpose of the service
Monestic is a tool for organising and projecting personal and household finances. It lets you record income, expenses, assets, net worth and financing, and obtain summaries, calculations and projections from the data you enter.
3. Nature of the service: not advice
Monestic does not provide financial, investment, tax, accounting or legal advice, nor personalised recommendations. The calculations and projections are automatic estimates based solely on the data and assumptions the user enters, are purely informational and do not guarantee future results. Any economic decision you make is your sole responsibility; we recommend consulting a qualified professional before making it.
4. Registration and account
Access may require an invitation. To use the service you must be of legal age and provide accurate, up-to-date information. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.
5. Acceptable use
You agree to use the service lawfully and not to:
- Enter third-party data without being entitled to do so, or special categories of data or data unrelated to the purpose of the service.
- Access, without authorisation, systems, accounts or data of other users, or attempt to breach security measures.
- Interfere with the operation of the service, introduce malicious code or reverse-engineer it except as permitted by law.
- Use the service for fraudulent, unlawful or bad-faith purposes.
6. Bank connection
If you enable the bank connection, it is provided through an account-aggregation provider authorised under PSD2. This feature is optional and depends on third parties. Monestic does not control the availability or outcome of the provider’s or your bank’s service and is not responsible for incidents, interruptions or inaccuracies attributable to them. You may revoke the connection at any time.
7. Your data and content
The data you enter is yours. You grant us only the licence necessary to host and process it in order to provide the service. You are responsible for the accuracy of the data and assumptions you enter; results depend directly on them. The processing of personal data is governed by the Privacy Policy.
8. Intellectual property
The software, brand, design and other elements of the service belong to Monestic or its licensors and are protected by intellectual and industrial property law. You are granted no right other than to use the service in accordance with these terms.
9. Service availability
We strive to keep the service available and secure, but it is provided “as is” and “as available”. We may modify, suspend or discontinue all or part of the service for maintenance, security or technical reasons, seeking to minimise inconvenience.
10. Disclaimer of warranties
To the maximum extent permitted by law, Monestic gives no warranties of any kind regarding the accuracy, completeness, fitness for a particular purpose, continuity or error-free operation of the service or its calculations and projections. You assume responsibility for your use of the information obtained.
11. Limitation of liability
To the maximum extent permitted by applicable law, Monestic shall not be liable for indirect, incidental, special or consequential damages, nor for loss of profit, loss of data, or the economic, investment or other decisions the user makes based on the service. In any case, and to the extent liability cannot be excluded, it shall be limited to the amounts actually paid by the user to Monestic in the twelve months preceding the event giving rise to it.
Nothing above excludes or limits any liability that cannot lawfully be excluded, such as liability for wilful misconduct or for death or personal injury.
12. Indemnification
You will hold Monestic harmless against third-party claims arising from your breach of these terms, misuse of the service, or entering data without proper authorisation.
13. Suspension and termination
You may stop using the service and request account closure at any time. We may suspend or terminate access, with prior notice where reasonable, if these terms are breached or if necessary for security or legal reasons.
14. Pricing and payments
If the service includes paid features, their prices and conditions will be disclosed before purchase. Unless otherwise stated, amounts already accrued are non-refundable, without prejudice to the rights granted to the user by consumer law.
15. Changes
We may update these terms for legal, technical or service-evolution reasons. We will publish the current version on this page with its date and notify you of material changes. Continued use after they take effect constitutes acceptance.
16. Governing law and jurisdiction
These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the courts of [COURT VENUE], unless the applicable consumer law provides a different mandatory venue in favour of the consumer.
